SUPPLEMENTAL SPECIFICATIONS
FOR
ON-CALL CONTRACTING - PATCHING

THE STANDARD SPECIFICATIONS, SERIES 2001, ARE AMENDED BY THE FOLLOWING MODIFICATIONS AND ADDITIONS. THESE ARE SUPPLEMENTAL SPECIFICATIONS AND THEY SHALL PREVAIL OVER THOSE PUBLISHED IN THE STANDARD SPECIFICATIONS
01043.01 DESCRIPTION
This work involves On-Call Contracting for Patching for the furnishing of labor, equipment, and materials in order to perform various items of patching work identified in the proposal form. This work is intended for repairs where time does not permit the work to be included in a regularly scheduled letting and an emergency letting is not justified.
These contracts will be based on geographical areas or Districts. The Contracting Authority will determine the need for the work and quantities to be performed. The bidder submits a bid based upon single units of work and the low bid will be determined based on a calculation of the unit bid multiplied times the units of work determined by the Contracting Authority. The initial bids may be used for numerous contracts over a 12 month period beginning with the date of letting.
The bidder submitting a proposal shall be a recognized contactor engaged in the class of work provided for in the contract documents. Before the contract is awarded to an apparent low bidder, they may be required to furnish evidence, to the satisfaction of the Contracts Engineer, of their ability to perform the work.
All bidders shall maintain a certificate of insurance according to Article 1103.04 of the Standard Specifications.
Following are the bid items to be used for this work:
01043.02 Issuance of Proposals
Article 1102.05 of the Standard Specifications will apply.
01043.03 BID OPENING
Article 1102.14 of the Standard Specifications will apply except that only bidders names will be read publicly. Individual line items and bid total will not be read. All bidders will receive a copy of the bid tabulations of all bidders.
01043.04 OFFERS OF WORK
The scope of work, once determined, and low bid calculations will be sent to all bidders. The low bidder will have 7 calendar days to accept or reject the offer of work based on the unit prices bid and the offer of work conditions. Accepted offers of work shall identify mix type, source, and invoice price. Negotiations of any type between the bidder and Contracting Authority will not be allowed. A bidder declining work will not be hindered from consideration for future work. A bidder may have their bid removed from further consideration for work by informing the Contracts Engineer in writing.
In the event the low bidder declines the work offer, the Contracting Authority will offer the same work offer to the next lowest bidder. This same procedure will be followed until a bidder accepts the offer, the list of bidders has been exhausted, or at least until the proposed cost of work exceeds 125% of the lowest bid.
01043.05 EXECUTION OF CONTRACT
Once a bidder has confirmed acceptance of the offer of work, the Contracting Authority will submit a simple contract to the Contractor for execution. Articles 1103.04 and 1103.05 of the Standard Specifications shall apply.
01043.06 WORK PERIOD
Work under this specification will use a Completion Date according to Article 1108.02 of the Standard Specifications. Liquidated damages will be $150.00 per day.
Contractor shall provide a minimum 48 hour notice to the Engineer prior to performing the work.
Contractor will have a minimum of 21 calendar days to commence work from the date of an executed contract. Contractor failing to complete work according to the contract may be removed from consideration for future work according to Article 1102.03 of the Standard Specifications.
01043.07 MATERIALS
Sources and types of mixes used shall be subject to approval by the Engineer. All HMA patches shall use an approved commercial mix. Certified plant inspection will not be required for either HMA or PCC patches.
The material used shall meet the requirements of Division 41 of the Standard Specifications for the respective items.
01043.08 Construction
The construction of patches shall be accomplished according to the specifications for the respective types of work unless modified by this Supplemental Specification.
All patches, regardless of length, will be checked with a surface checker by the Engineer and shall not exceed 1/8 inch in 10 feet (3 mm in 3 m).
01043.09 METHOD OF MEASUREMENT
The Engineer will measure each of the following items according to the Standard Specifications:
01043.10 BASIS OF PAYMENT
The Contractor will be paid the contract unit price for the various items of work satisfactorily performed and measured according to the units above.
The Contractor will receive the actual cost of PCC and/or HMA mix delivered on the work, heating of PCC materials if necessary, calcium chloride added to PCC mixes, and the freight and handling charges as shown by original receipted bills, to which cost will be added a sum equal to 15% thereof.
The Contracting Authority will pay the Contractor by means of a voucher initiated by the Engineer. This payment will be made within 15 calendar days following physical completion of the work, but only applies to progress payments. Final payment will be made according to Article 1109.09 of the Standard Specifications.
Over depth excavation due to poor subgrade conditions will be considered as extra work and paid for according to Article 1109.03, B, of the Standard Specifications.
Flaggers and pilot cars will be paid for according to Article 2528.13, A, 6 and Article 2528.13, A, 7 of the Standard Specifications.
The prices paid to the Contractor will be increased by an additional 25% over the contract unit prices (not including HMA or PCC mix prices) if the work is required to be accomplished during the hours between one-half hour before sunset until one-half hour after sunrise.
